AI Terms of Service for your book?

I’ve seen some authors start to include a statement below the copyright in their front matter saying “no part of of this book can be used for AI training” as a part of their “All rights reserved.”

It’s questionable whether or not that would hold up in court, but if it did, I had another idea: would it be possible to include an AI TOS in your book?

“By including this book in your AI training dataset, you agree to the following…”

I had this idea because I want my ideas included in AI, but I also want those AIs to be open source. I don’t think for-profit companies should get to use my work and then pay-wall me from my own ideas. If I helped make it, it’s mine too, and if it was made without regard to copyright, it should be given without regard to copyright.

My current legal understanding is that even a statement saying you can’t use a book for AI training data might not hold up, but I think an explicitly written TOS might at least make it to court if a complaint was filed. Others might know better than me.

At minimal, if “AI-licensing” becomes a thing, it might be useful to tell people “you can train your AI on my book under these terms without asking me” to speed up the process, so that you don’t have to reply to every individual licensing request.

What do you think? Has anyone spoken with lawyers or people in the publishing industry who would know?
