AI training and piracy

Someone in another of my author groups posted that The Atlantic is doing a deep dive on Meta’s use of “pirated books” to train their LLMs and that the database can be searched by any author who’s curious to see if their work is in the training set: https://www.theatlantic.com/technology/archive/2025/03/search-libgen-data-set/682094/. Authors are up in arms and saying their work was stolen, and a lawsuit has been in the works for a while. But is this actually piracy? I assume the copyright concerns are because the books were scanned without authors’ consent, but the training part doesn’t seem like piracy (even if piracy were a major threat, which it isn’t to me). @Thomas Umstattd Jr., I should have asked this in the last Patrons Q&A, but it wasn’t brought to my attention until yesterday.
